The Program | Service

The Toowoomba Community Legal Service provides an initial consultation in most matters of Civil and Family Law.

 

The service provides access to qualified solicitors who can explain your legal rights and obligations, and outline various options and steps you can take to solve your legal problem.

Are you eligible for this service?

Vulnerable or marginalised members of the community, subject to a general assessment criteria, are eligible for this service, subject to a conflict of interest check.

What does the service provide?

  • Free Legal Advice and Assistance in many areas of Civil Law and Family Law with the exception of Property Settlements.
  • Service includes initial advice, referral to private solicitors or other avenues of legal assistance, and help with the preparation of Court documents and the provision of self-help material to assist people who need to represent themselves in Court.
  • Advice and limited advocacy and legal representation to clients with a disability facing the Criminal Justice System.

A list of our Services

FAMILY LAW
If you are seeing us about a family law matter, which may include initial advice, referral, assistance with preparation of Court documents or access to other legal or advocacy support in any of the following areas:

 

  • Separation and/or divorce
  • Parenting
  • Domestic violence

 

You will need to bring the following with you to your 1st appointment:

 

  • Any paperwork, including letters, court documents or existing orders that relate to your matter
  • A copy of your Marriage Certificate
  • A copy of your Health care card in order to be able to apply for a waiver of court filing fees (namely, divorce application filing fee)
  • An appropriate support person, if necessary

CIVIL LAW
If you are seeing us about a civil law matter, which may include initial advice, referral, assistance with preparation of Court documents or access to other legal or advocacy support in any of the following areas:

 

  • Credit/debt
  • Motor vehicle accidents
  • Neighbourhood disputes – dividing fences
  • Peace and Good Behaviour orders
  • Consumer complaints

 

You will need to bring the following with you to your 1st appointment:

 

  • Any paperwork, including letters, court documents, receipts, quotes or invoices that relate to your matter
  • Any photographs
  • Any notes you may have about the matter
  • An appropriate support person, if necessary

TOOWOOMBA COMMUNITY LEGAL SERVICE – HOTLINE
In July 2014, TCLS commenced operation of its free legal advice telephone hotline to people living in regional, rural and remote areas of South West Queensland to secure same day/within 24 hour advice in relation to family law, civil law and generalist matters, with appropriate referrals being made as required to either external organisations, solicitors or to one of our internal programs.

USQ STUDENT CLINICS
On Thursday 18 June 2015 TASC held the very first ‘USQ Student Consultation Clinic’ at the University of Southern Queensland, Toowoomba Campus in conjunction with USQ Student Services. This clinic is available for USQ students and provides a free form of triage, information and referral pathways to students in general matters with a focus on civil, family, criminal/traffic and generalist areas of law, including:

– Consumer disputes
– Debt disputes, including debts owed and owing, including Centrelink
– Refunds of bonds from tenancies and boarding houses
– Neighbourhood disputes, fencing and tree disputes, noise and nuisance disputes
– Contractual disputes
– Motor vehicle accidents with property damage and insurance cases
– Peace and Good Behaviour matters
– Domestic Violence Protection Orders
– Separation and Divorce, Family law disputes involving children
– Parenting issues

 

When?
Every second Thursday between 9:00 am and 11:00 am in the refectory building, Room R114B (straight across from the coffee shop).

Who is eligible for this service?
Students of USQ unable to afford to see a private legal practitioner or obtain Legal Aid assistance, subject to a conflict of interest check.

 

What to bring to an appointment
All paperwork, forms or other related information. People are also welcome to bring a support person to the appointment.
